Agreement to Terms

By downloading, installing, or using Systolio ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Systolio is a health data logging application that allows you to:

• Record and track blood pressure, blood sugar, heart rate, and BMI readings
• Store medication information
• View historical data and generate charts
• Export data in CSV or PDF format
• Set medication reminders (optional)

What Systolio Is:

• A personal health data logging tool
• A tool for tracking user-entered health metrics
• A tool for organizing and viewing your health data over time

What Systolio Is NOT:

• A medical device
• A diagnostic tool
• A treatment or therapy
• A replacement for professional medical care
• A tool that measures or interprets your health status

Medical Disclaimer

You acknowledge and agree that:

• You are responsible for the accuracy of all data you enter into the App
• The App is intended for personal tracking and informational purposes only
• You will consult with qualified healthcare providers for all medical decisions
• You will not rely on the App for medical diagnosis or treatment
• In case of a medical emergency, you will call 911 or your local emergency services immediately
• Veriris LLC and its developers are not healthcare providers and do not provide medical services

No Medical Relationship: Use of Systolio does not create a doctor-patient relationship, therapist-patient relationship, or any other professional healthcare relationship between you and Veriris LLC or its developers.

User Responsibilities

Accurate Data Entry

You are solely responsible for:

• Entering accurate health readings and information
• Verifying the accuracy of data before saving
• Maintaining the integrity of your data
• Backing up your data using the export features

Data Backup

Systolio stores all data locally on your device. You are responsible for:

• Exporting and backing up your data regularly using the App's export feature
• Preserving exported data if you plan to switch devices
• Understanding that uninstalling the App will delete all data on your device
• Understanding that device failure, loss, or theft may result in permanent data loss
• Maintaining your own backup copies to ensure data recovery is possible

We are not responsible for data loss due to:

• Device failure, loss, or theft
• Accidental deletion
• App uninstallation
• Operating system updates or changes
• Database corruption or app data corruption
• Software bugs, crashes, or technical malfunctions
• Storage failures or file system errors
• Any other circumstances beyond our control

Appropriate Use

You agree to use Systolio only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or other proprietary notices
• Interfere with or disrupt the App's functionality
• Use automated systems to access the App

Intellectual Property

Our Rights

Systolio, including its design, code, graphics, text, and other content, is owned by Veriris LLC and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to:

• Download and install Systolio on your personal device
• Use Systolio for your personal, non-commercial health tracking purposes

This license does not include the right to:

• Copy, modify, or distribute the App
• Create derivative works based on the App
• Use the App for commercial purposes
• Remove or alter proprietary notices

Your Data

You retain all rights to the data you enter into Systolio. We do not claim ownership of your health data or personal information.

Privacy

Your privacy is important to us. All data you enter into Systolio is stored locally on your device and is never transmitted to our servers or shared with third parties (except as described in our Privacy Policy regarding advertising and analytics).

Please review our Privacy Policy to understand how we handle your data.

Advertising

Systolio is free to use and is supported by minimal, non-intrusive banner advertisements. These advertisements:

• Are non-personalized (we do not use your health data for ad targeting)
• Are static banner ads only (no pop-ups, videos, or interactive ads)
• Are provided by third-party advertising service providers

You acknowledge that:

• Advertisements may appear while using the App
• We do not control the content of third-party advertisements
• Clicking on advertisements may take you to third-party websites
• Third-party advertising services have their own privacy policies and terms

Platform-Specific Terms

The following additional terms apply based on where you downloaded the Systolio application:

iOS App (Apple App Store)

If you downloaded Systolio from the Apple App Store, the following terms apply:

Acknowledgement: These Terms are concluded between you and Veriris LLC only, and not with Apple, Inc. ("Apple"). Veriris, not Apple, is solely responsible for the Systolio application and its content. These Terms may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions.

Scope of License: Subject to these Terms, Veriris grants you a limited, non-transferable license to use the Systolio application on any Apple-branded products that you own or control and as permitted by the App Store Usage Rules. The Systolio application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

Maintenance and Support: Veriris is solely responsible for providing any maintenance and support services for the Systolio application, as specified in these Terms or as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Systolio application.

Warranty and Refunds: Veriris is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed herein. In the event the Systolio application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Systolio application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Veriris's sole responsibility.

Product Claims: You acknowledge that Veriris, not Apple, is responsible for addressing any claims by you or any third party relating to the Systolio application or your possession and/or use of the application, including, but not limited to: (i) product liability claims; (ii) any claim that the Systolio application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the Systolio application's use of HealthKit and HomeKit frameworks (if applicable).

Intellectual Property Claims: You acknowledge that, in the event of any third-party claim that the Systolio application or your possession and use of the application infringes that third party's intellectual property rights, Veriris, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Legal Compliance: You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties, including the Treasury Department's Specially Designated Nationals List or the Commerce Department's Denied Persons List or Entity List.

Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms with respect to the iOS application, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

Third-Party Terms of Agreement: When using the Systolio application, you must comply with applicable third-party terms of agreement, including but not limited to your wireless data service agreement.

Android App (Google Play Store)

If you downloaded Systolio from the Google Play Store, the following terms apply:

Distribution and License: The Systolio Android application is distributed through Google Play Store. Google LLC acts as an agent to make the application available but does not undertake an obligation to monitor the application or its content. Upon download, you receive a non-exclusive, worldwide, and perpetual license to use the Systolio application on your Android devices.

Family Sharing: You may share Systolio with other family members in your Google Play family group, subject to Google Play's limitations and policies.

Refunds: Google may issue refunds to users in accordance with Google Play refund policies. All refund requests for purchases made through Google Play must be directed to Google. Veriris is not responsible for processing refunds for purchases made through Google Play. Google may deduct any refund amounts from payments owed to Veriris.

Support Obligations: Veriris is solely responsible for providing customer support for the Systolio application. We will respond to customer support inquiries within 3 business days.

Product Removal and Refunds: If Systolio is removed from Google Play due to a legal takedown and you purchased the application within one year (or longer as required by local consumer law) before the date of takedown, Veriris will refund to you all amounts paid for the application. Upon such removal, you will no longer have the right or ability to reinstall the affected application.

Google's Disclaimer: Google Play is provided "AS IS" and "AS AVAILABLE" without warranty of any kind. Google expressly disclaims all warranties and conditions of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Google will not be responsible for, and will not have any liability whatsoever under, these Terms or your use of Systolio.

Google's Limitation of Liability: Google, its subsidiaries and affiliates, and its licensors will not be liable under any theory of liability for any indirect, incidental, special, consequential, or exemplary damages that may be incurred by you, including any loss of data, whether or not Google or its representatives have been advised of or should have been aware of the possibility of any such losses arising.

EULA Relationship: To the extent that these Terms conflict with the Google Play Developer Distribution Agreement, the Developer Distribution Agreement will supersede these Terms. Google is not responsible for and has no liability under these Terms.

Disclaimers and Limitations of Liability

No Warranties

Systolio is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of data
• Uninterrupted or error-free operation

Limitation of Liability

To the maximum extent permitted by law, Veriris LLC, its developers, employees, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, or business opportunities
• Personal injury or property damage
• Any damages resulting from your use or inability to use the App
• Any damages resulting from data loss, database corruption, or app data corruption
• Any damages resulting from device failure, software bugs, or other technical issues
• Any inability to recover lost or corrupted data
• Any damages caused by operating system updates, storage failures, or file system errors

Total Liability: Our total liability to you for any claims arising from or related to your use of Systolio shall not exceed the amount you paid to download the App (which is $0, as the App is free).

Medical Liability Disclaimer

We are not liable for:

• Any health decisions you make based on data in the App
• Any medical outcomes resulting from your use of the App
• Any misinterpretation of data displayed in the App
• Any failure to seek appropriate medical care
• Any reliance on the App for medical diagnosis or treatment

You assume all risks associated with using Systolio for health tracking purposes.

Indemnification

You agree to indemnify, defend, and hold harmless Veriris LLC, its developers, employees, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of Systolio
• Your violation of these Terms
• Your violation of any rights of another party
• Any data you enter into the App
• Any health decisions you make based on App data

Changes to Terms

We may update these Terms from time to time to reflect changes in our practices, the App, or for other operational, legal, or regulatory reasons. For material changes, we will provide notice through the App before changes take effect.

The "Last Updated" date at the top of these Terms indicates when they were last revised. Your continued use of Systolio after any changes constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the App and uninstall it from your device.

Termination

Your Right to Terminate

You may stop using Systolio at any time by:

• Uninstalling the App from your device
• Deleting all data through the App's settings

Note: Uninstalling the App will delete all data stored on your device. Export your data before uninstalling if you want to preserve it.

Our Right to Terminate

We reserve the right to:

• Discontinue or modify the App at any time
• Suspend or terminate your access to the App if you violate these Terms
• Remove the App from app stores

We are not liable for any damages resulting from discontinuation, modification, or termination of the App.

• You have read and understood these Terms of Service
• You agree to be bound by these Terms
• You understand the medical disclaimers and limitations of liability
• You are solely responsible for regularly backing up your data using the export feature
• Data stored locally may be lost or corrupted due to technical issues, and you accept this risk
• The developers are not liable for any data loss, corruption, or inability to recover data
• You will consult healthcare providers for medical decisions
